EXERCISE : PREPARING THE COMPLAINT FOR EXPROPRIATION AND ANSWER/ class exercise/ submit next week/ per student

 FACTS:


THE city of Dipolog headed by Mayor Darrel Uy upon a resolution passed by the City Sanggunian wants to expropriate  a land owned by Mr. Ruperto Vidal ( covered by TCT No. 4567, covered by Tax Declaration No. 980 with an area of 100 square meters) to be used as a a road connecting the National Highway to the Port of Galas. Negotiations were made but the owner refused the offer of 2M as fixed by the Sanggunian.

Ruperto Vidal refused the offer since he wants the price to be 8M. He also reasoned out that his property is too small and he had no other property of his own, Said property is the site where her residential house is situated.He questions the taking as improper as there are other properties along the area which could be taken by the government. Ruperto Vidal, is 60 years old, a widower, and a retired public school teacher.


PREPARE THE COMPLAINT FOR EXPROPRIATION of Mayor Darrel Uy and the ANSWER of Mr. Ruperto Vidal.

Apply the procedure outlined under the Local Government Code, Section 19 thereof, in relation to Rule 67 of the Rules of Court
