EXERCISE 1 COURT PRACTICE (in the CITY COURT)

 FACTS: Mr. Santos obtained a loan from the Rural Bank of Dipolog for a sum of P30,000 at 3% per month and penalty charge of 2% per month if the obligation is not paid on time. This is evidenced by a promissory note. The loan is secured by a mortgage of his property (i.e. 250 square meters covered by TCT No. 5431 with an assessed value of P40,000. situated in Labason, zn).  Mr. Santos only paid two installment payments of the interest but the principal remained unpaid. The  promissory note already matured on February 30, 2021.  Mr. Jose Santos is 50 years old, employed as elementary school teacher in Segabe, single, resident of Katipunan St., Dipolog City. The Rural Bank of Dipolog is a banking corporation with principal office in Dipolog City. The court is filed in the City of Dipolog presided by Judge Chad Paler.

Prepare the complaint for a small claim from the perspective of the Rural Bank of Dipolog.

Prepare the ANSWER from the perspective of Mr. Santos.

Prepare the Decision of the court (City court of Dipolog) within 24 hours.
